I let a mechanic do the struts on my 1993 plymouth acclaim come to find out he spray painted my old struts?

i gave him over 237.00 on july 15 2009.i found out yesterday the struts are my same ones no new ones 70.00 apiece plus 160.00 labor. can i sue him.it looks like he painted tar on to the struts.no metal visible at all.i'm really hurt
